8/1/18 - Julie Williams on a Possible OCC Approach to Legal Doctrines on Bank Loans Sold to Third Parties

Promontory Managing Director and Director of Domestic Advisory Practice Julie Williams was interviewed by Bloomberg BNA for an article on court opinions related to loans originated by a bank and then sold to third parties, a topic in a new Treasury Department report.

Williams explained that the Office of the Comptroller of the Currency could indicate its position on the “valid when made” and “true lender” legal doctrines with an amicus brief. This could be a faster route than a rulemaking requiring notice and comment periods.
